Therefore, DOSMIOS Services is subject toYourcontinued registration on the Platform with respect to Your capability in Continuity of using our Platform. YOU(User/Visitor) are strictly advised to often Read the Term & Conditions thoroughly & carefully. By accessing the services provided by the Platform You are agreed to OUR(DFFPL) terms provided in this Terms & Conditions document.
Please note, that DOSMIOS “DFFPL” deserves the right to display the information, feedback, reviews, ratings etc... I.e. provided by YOU(USER/VISITOR) on the Platform during & after Registration. You “agree and accept” that as on the date of Your registration on our Platform, that the information provided by You is accurate, complete, no false data provided & up-to-date. Please make sure that, services of this Platform would be available to Customers only on select geographies in India &at present accessible to Visakhapatnam, Andhra Pradesh Location only. If in case anyone/Any person Proved “inept to Contract” with respect to Act - Indian Contract Act, 1872 including un-discharged Bankruptcy etc. are ineligible to use the Platform.
a. Age Limit terms: If You are Adolescent, i.e. under the age of 18 years(minors), Few strict suggestions need to be followed. DFFPL’s Platform and its process including its assortment and arrangement, but not limited to, all images, text, videos, graphics illustrations, User & visual interfaces, sound clips & Music clips, algorithm, artistry and computer code (and any combination therein), except any third party software available on the Platform, is owned by DOSMIOS so called “ DOSMIOS PROPERTY”. Hereby, the Model, Design, Selection, co-ordination, appearance, its view and feel and arrangement of such DOSMIOS Property is Right protected by various other intellectual property rights & and copyrights, patent and trademark laws also. You are prohibited & unauthorized for the usage of DOSMIOS Property without prior written consent by DOSMIOS DFFPL.

Trademark terms: Excluding the Logos, trademark & Service marks of any third parties, rest all “Trademarks, Logos, & service marks” displayed on the Platform are direct property of DOSMIOS “DFFPL”. Hence,Youare not Prohibited& legally authorized to use the “Marks” without the prior written consent of DOSMIOS or such third party as may be applicable.
V. User Obligations & Security Terms
You(User/Customer) are solely accountable for and in control of the information provided with Us. At first all the Users/Customers need to register and login for placing orders, for accessing /or to avail “DOSMIOS Offers” on the Platform. Keep a note that,Youmust have to register and create an Account on our Platform incorporating an unique “User identity and password” for the Account.
YOU need to install the application on a Compatible mobile or/ tablet and then only can proceed with Registration procedure. Therefore, compilation of USER Accounts with respect to bearing contact/registered number and registered e-mail addresses etc.., details are solely owned by DOSMIOS “DFFPL” only. You make sure, that certain information should be handled sensibly which is Case sensitive & the same need to get understood and agreed fromYourend at first.
Please keep a note, thatYouare solely responsible for maintaining the confidentiality & also pay complete responsibility for overall activities that occur under Your Account & Account information in the Platform.
User/Visitor must accept and agree with below pointers.
User/Customer must ensure US that to exit from Your Account at the end of each session at any moment.
You must immediately notify US, if found of any unauthorized usage of Your Account /Account information or any other breach of security traces. Also usage of another.

YOUR(User/Visitor) Account shall be indefinitely suspended, if incase in the platform, it was unable to establish unique identity of the USER against a provided/valid mobile number or e-mail address & in connection to above DOSMIOS “DFFPL” reserves full rights as in order to suspend User's Account and does not have the liability to share any Account information whatsoever.
VI. Product Pricing & its Availability
Pricing of all products are solely defined & confirmed by DOSMIOS. Although, the prices mentioned on the day/time of booking order will be the prices charged on the date of the delivery without any changes in effect. Please note, all the product itemized on the Platform will be sold at M.R.P unless & otherwise specified with certain discount offers. Although, prices does not fluctuate on day-to-day basis for most of the listed products, therefore for some of the commodities and fresh food (Vegetables etc..,), prices do change on a regular basis.
In addition to above statement, if in case product prices vary (higher or lower) on the date of delivery, no additional charges will get imposed /or refunded at the time of the delivery of Your order. Please note, all of the products listed in the platform are subject to the availability of same. We “DOSMIOS” reserves the right in order to impose quantity limitations “all time” on any order, with respect to a)reject the whole order, b)or else some part of an order, c) to discontinue Products without prior notice, although the order has already placed in the Platform.
VII. Payment/Financial Terms and Conditions
Upon selection ofYourrequired items/products on the platform, the next option is to initiate a request for Purchase of the same. IX. Rating Terms
DOSMIOS guide every User to agree with below mentioned,
(i) Post successful completion of each & every transaction on our Platform, automatically Platform prompt You with a notification/option as in order to provide a Feedback & Rating about rendered Qualitative service of assigned Delivery Executive and also about Product sold/provided by Company.
(ii) In Accordance to above statement, our Delivery Executive may also promptYouto provide Feedback & Rating on the Platform. Basis, the ratings rendered to Delivery Executive, Your rating score will get determined and displayed and also visible to all USERS on our Platform, Hence You are agreed to the statement.
(iii) DOSMIOS reserves whole authority/right to use, manage & control, display, share & delete such Feedback & Rating provided by USER in any way concerning about the business of DOSMIOS “DFFPL” without any approval or acknowledgement of Users and hereby You must accord to the same. In connection to above, DOSMIOS is fully authorized to modify or delete particular feedback which contains obscenity/ or any kind of offensive words in the event that such comments include obscenities or other objectionable & Obnoxious content, which may include an individual/USER name or their personal information, or Violating any privacy laws or other applicable laws or/ DOSMIOS’s content policies.
X. Cancellation and Refund Terms
DOSMIOS will promptly approve and execute the transaction (Order placed) initiated fromYourend, upon receiving confirmation from You for the same. At any moment, if You wish to withdraw/cancel an active transaction/already placed order on our Platform, You shall opt the “cancel” option on the Platform & In connection to above, a point need to be noted that You are subjected to pay a cancellation fee for transaction (active order) initiated on our Platform for which process has already been originated by DOSMIOS Employees (Team).
Keep a note, about the general rule, that You are not permitted to cancel Your order which is already confirmed by both I.e..(YOU & DOSMIOS). DOSMIOS own authority/right to chargeYouagainst Your Cancelled Order/Transaction with a cancellation fee of a minimum INR 70 Up to the order value which wholly depend upon Company Decision only.
DOSMIOS may cancel the transaction initiated/Placed Order by You on the Platform, basis below conditions:
● When You Fail to respond to phone call /or through any other communication channel at the time of confirmation of the order booking.
● If USER provided/Delivery address is outside the Service zone of DOSMIOS. In Connection to above, Delivery address instructions or Information and or authorizations provided byYouproves insufficient or not complete to execute the transaction initiated by You on the Platform.
● IfYouhave initiated the transaction/placed order for a Product/item (which is already out of stock) &If a Delivery Executive is not available to perform the services, whosoever assigned for the same.
● If any transaction could not be completed for reasons not in control of Company, You shall only be entitled to claim replacement for Order placed /(transactions initiated) by YOU, if in case You have pre-paid the fees with respect to such transaction/ paid transaction, also You shall be eligible to get the refund which is truly Company Decision.
● At the time of delivery, ifYourpackage has been damaged or tampered, as determined by DOSMIOS basis the parameters established by DOSMIOS in its sole discretion.

Overall Refund/Replacement decisions will be at the sole discretion of DOSMIOS and in accordance with DOSMIOS’s internal refund policyterms&Metrixand the same shall be final and irrevocable. Remember, in order to return the item purchase, You are hereby to inform us ‘DFFPL’ within 24hrs timeline from date of purchase of the product.
As per Company Policy, all the refunds initiated by DOSMIOS shall be refunded to Your source account through whichYOU have initiated the transaction on our Platform /or else credited to DOSMIOS WALLET(D-wallet) based upon Company policy.
XI. Disclaimer of RepresentationandWarranties& Terms of Use:
DOSMIOS permit all USER's a non-exclusive, limited exemption & privilege to access and use our Platform and in order to acquire DOSMIOS Services concerning to Compliance with the Terms of Use.
• YOU are solely &legally authorized to view and for accessing our Platform as in order to avail DOSMIOS Services, &Youaretruly entitled and permitted for the same.

(iv) in connection to above You must entitled & justified that, no legal proceeding are still pending/active(while using the platform) against You with respect to any Tribunal. If Legal proceeding are still active against YOU, that may prohibitYoufrom accessing the Platform and to avail the DOSMIOS Services.
• YOU must bind &concur with the term that not to access DOSMIOS Platform. In Connection with above statement,Youmust agree not to access by any means except the UI/User interface that is provided by DOSMIOS.
YOU must agree with below terms before accessing the Platform
(i) YOU are not authorized or not permitted & also unlawful in usage of any web crawler, deep-link& robot techniques, web robot or any other kind of automatic device programme /techniques, technicalities /algorithm or methodologies or Procedures, or/ any other alike or identical procedures which may be Automatic/manual in order to attain, replicating/ imitating(content/data) or monitor accessing, any portion/part of our Platform or else imitation of our whole content is also strictly prohibited & illegitimate.

You must agree & acknowledge with above terms.
✔ You( refers to a Person or an Entity) make sure, that without express Written consent by DOSMIOS, It was unlawful act &strictly prohibited the act/attempt tocopy, add, delete duplicate, distortion, reproduce, reissue/ reprint, post/ repost/, modify or sell, download, transfer or to distributeCompany Material/ Content in any mannerorelsemisusing/usingthe same for any other purposes beyond Company predefined Terms of Use(Terms & conditions).

✔ In connection to above, youmust agree & accept to pay all reasonable attorney’s fees and costs against all violation caused by you. Keep a note, to read all the terms thoroughly before You Login to the platform.
✔ In Order to avail the promotional offers available through the Platform, You must agree, comply & follow the Rules & Conditions or guidelines/or terms which shall form a part of this “Terms of Use”.
XII. Account Deletion/ Termination policy/terms :
Make a note, that this “Terms of Use” will be applicable until & unless terminated/sacked either byYouor DOSMIOS as set forth below in detail.
• If in case You as a “User/Visitor” not satisfied or else protest against these “Terms of Use”/ or DOSMIOS’s Services available in the Platform then Your only choice is to (a) Write us at info@DOSMIOS.in to closeYouraccount Or else (b) stop accessing our Platform/Website permanently.
• DFFPL owns complete authority to deactivate Your account upon receiving receipt of request in writing directly through Your registered email Id to us atinfo@dosmios.in
• YOU are hereby agree and acknowledge thatonce Your account get terminated,in immediate - DOSMIOS shall own right & sole authority to retain all information pertaining to the transactions initiated by You on the Platform.
XIII. Report Abuse/ Report Us(DFFPL) :
Please highlight/ reportus at e-mail id: info@dosmios.in, if in case/ any eventYouencountered any kind of Violation/ abuse of these “Terms of Use” Or if have any other queries with the same. In Connection, You can highlight us at e-mail id: info@dosmios.in, if You become aware of any Objectionable content/ Other User/Visitor’s obscene/ vulgar/ Filth any such kind of commentaries in the Platform.
XIV. Infringementof IP Address :
Please note, DOSMIOS Platform do not violate YOUR(User/ Visitor’s) intellectual property. IfYoustill believe the Platform violates Your intellectual property, please write/ update us at legalnotices@dosmios.in. In Connection, owner of the intellectual property is sole responsible &authorized to share these kind of updates with us(DFFPL). In such case of Owner absence, an agent duly permitted to act on his/her behalf.
Though, DOSMIOS DFFPL own right/ authority in order to terminateYouraccount on spot/ to bar Your access to the Platform, if in case encountered any false claim from Your end.
You are required to provide the following details inYournotice:
• YOUR registered contact number(email & phone number) & one alternate contact number(mobile/telephone) and Your address. IfYouencounter any of the below mentioned.
IfYoubelieve/ or identify as Your intellectual property is being infringed or violated. Or else, In You identify that Your intellectual property is not authorized by itssole owner, or connected agent, or the law to be used in connection with the Platform, then promptly highlight us with sufficient information, whereincluded statement that You strongly believe with good faith/ or else where the material is located on the platform.
In Connection, You make sure to verify whether provided statement is accurate or not shared fromYourend.
Intellectual property owner’s physical/ electronic Signature must provided to Us(DFFPL). If an agent authorized to act on behalf of the intellectual property owner, then also owner physical/ electronic signature should be provided with us in mandate.
XV. Communications :
Please make sure to agree thatYoureceive notifications/communications/alert messages through our preferred sourcesI.e. via SMS’s and /or through e-mails from DOSMIOS ‘DFFPL’ to share our services/products/offers/etc... Updates.
If in case ofYourdisinterest in receiving our updates, Please do opt for unsubscribe option & opt-out from receiving notifications through SMS and e-mail anytime by contacting DFFPL for the same. However, If You still receive few notifications/communications from our end which completely based uponYourusage of our Services.
Notifications : All of the DOSMIOS ‘DFFPL’ notifications/noticeswill be shared by email toYourregistered email id /or through general notificationshighlighting on the Platform.
XVI. Delivery Executive & DFFPL Service Rating Terms :
Please note, once item is delivered to User by Delivery Executive (‘Delivery Executive’ referred as ‘DE’), next immediately Platform/App will prompt the USER with an option to provide a rating about assigned DE Services & DFFPL Services as well, furthermore You can provide additional comments or feedback about the same.
You agree & acknowledge to follow below pointer prior to providing rating & feedback.
✔ YOU shall provide Ratings and Feedback about DE & DFFPL Services in good faith and in unbiased manner. Your comments/ Feedback should not contain objectionable matter to DFFPL & Other User’s, Obscene, Vulgar, Filthy etc..,
✔ DOSMIOS ‘DFFPL’ and its affiliates reserve the right to use, share and display Your Ratings and Feedback in any manner in connection with the business of DOSMIOS and its affiliates withoutYourattribution or approval. You hereby accord to the same
✔ In Connection to above, DOSMIOS and its affiliates reserve the right to remove comments from Platform in an event that such comments include obscenities, Vulgarity, offensiveness, offending any religion/nation/country/Person etc.. orany other objectionable content, include an individual’s name or their personal information, or violate any privacy laws, legitimate policies, intermediary guidelines, other applicable laws or DOSMIOS’s or its affiliates’ content policies.
✔ Please make sure to follow all the DFFPL guidelines before sharing Commentaries/ Feedback in the Platform.
✔ Remember, all the Delivery Executives are aware and strongly follow recommended preventive measures to ensureYouand our community to stay safe. Remember, at present our services are restricted to Visakhapatnam selected zones only. Kindly do cooperate with us, till we share further update upon expansion of our delivery zones.
DOSMIOS WALLET / D-WALLET & Referral Programme(Terms of Use)
Please Note, the following terms and conditions are applicable to DOSMIOS Wallet (D-Wallet “T&C”).
These D-Wallet Terms of User(T&Cs) are in addition to and will be read with the Term of Use(Terms and Conditions) available here. Here D-Wallet ‘T&C’ will be revised at the discretion of DOSMIOSFresh Foods Private Limited("DOSMIOS") and such amended terms will be posted here. Hence You are strongly advised to refer DFFPL ‘Terms & Conditions’ at each interval for latest updates & Update posted date will be highlighted every time on top-right side. Please review these D-Wallet/ DOSMIOS Wallet T&Cs from time to time to know updates about the same.
D-wallet Rule(A) :
✔ D-Wallet / DOSMIOS Wallet is a true form of redemption points given by DFFPL for all of the users on the DOSMIOS Platform either ‘App or Website’offered when User made online mode of payment only as defined by DOSMIOS& DFFPL ‘terms of use’. DFFPL reserves authority to askYouabout certain information related to proceed Your KYC (know Your customer) Verification, hence You are responsible to provide required information to gain access for usage of D-Wallet on the platform.
✔ Hereby note, the importance of D-Wallet issued by DFFPL is, that D-Wallet Cash/points maximum usage per order & also the validity of D-Wallet/D-Wallet Cash may vary from time to time. The same will be indicated/highlighted to User on their respective Dosmios App/Website.
✔ Please note, Cash/Points in D-Wallet cannot be converted into actual currency or cannot withdrawn or transferred to another User/User’s accountby no means. In Connection, You must agree & acknowledge that D-Wallet/ Dosmios Walletcannot be used for business or corporate purposes or for any other purposes except forYourpersonal use in the platform through Your registered account. D-Wallet cannot be redeemed for cash/currency & it is not transferable and may not be auctioned, traded, bartered or sold is wholly unlawful act.
✔ You are hereby need to be noted that, manipulating/exploiting the usage of D-Wallet Cashor insisting/ assisting others to exploit the same is strictly prohibited, which result in swift suspension/termination of Your account & also usage of D-Wallet which will be completely DFFPL decision.
✔ You must acknowledge not to create multiple accounts, fictitious or accounts with fake id/ fack accounts in the Platform or with Dosmios. In connection, You(Users/Visitors) Should notviolate any law, infringe or violate the rights, or otherwise act in a manner that is deemed unfair, disruptive, harassing, harmful, illegal while using D-Wallet.
✔ You are unauthorized to collect or harvest any personally identifiable information or to use any system/bot or any other device in order to participate /or to receive any benefit through the Offer programme of Dosmios is strictly unlawful act.
D-wallet Rule(B) :
✔ D-Wallet may not be applicable on certain items &for certain services which was made available in Platform, which was independent discretion of DOSMIOS DFFPL. These restricted items will be indicated to the User on the Dosmios App/Website. D-Wallet cannot be clubbed with any other discount/ or offer which run on the DOSMIOS App.
✔ You should agree & acknowledge that, in case of any issue pertaining to the quantum of/ usage of D-Wallet, hence the solely &independent decision made by DOSMIOS shall be final and binding,Youshould admit it before usage of the platform.
✔ DOSMIOS,itself own sole authority/ right to suspend user account upon investigation. In Connection, in the event, if ‘DFFPL’ believes that any of theUser has acted fraudulently for availing Cash in D-Wallet/ or has used D-Wallet in a manner inconsistent against the D-Wallet T&C’s. In Connection to above, note that during investigationphaseYouare unauthorized in accessing to use D-Wallet in the platform.
✔ DOSMIOS reserves the right to terminate eitherD-Wallet or to modify the D-Wallet’s T&Cs /or beneficial offers at any moment, withno reason or without any prior notice to users. This wouldn’t affect in existing users D-Wallet. In Connection, DFFPL is sole authorized to perform afore said actions &Youmust agree and acknowledge with the same.
✔ DFFPLis sole authorized & hold rights to disqualify/terminate any Userfrom using D-Wallet at any moment, if Company believes User violated any of these D-Wallet T&C/ or the UserT&C’s in Dosmios App/ Website.
✔ Please note, that these D-Wallet T&C’s shall be governed by and interpreted/Construed in accordance with the laws of India without reference to conflict of laws principles.
D-Wallet Offers/ Referral Programme :
DFFPL, DOSMIOS Referral Programme is a reward program initiated by DOSMIOS Fresh Foods Private Limited(“DOSMIOS”) for encouraging eligible Users to refer the DOSMIOS App to their friends and family to availall D-Wallet Benefits & Offer services.
Please do ready carefully below said in order to avail D-Wallet Offers/Benefits provided by Dosmios.
✔ Hereby, each Eligible/Existing User(Existing user is called ‘Referee’) need to share App link by clicking on “Share” option in the Platform with people known to them personally like their Friends & Family members.

✔ Please note, any violation/fraudulent activity of these terms of use T&C’s leads to immediate suspension/disqualification/Termination of Your account in Dosmios, &in addition to exposure to further legal action. Hence Dosmios do not tolerate breach of Company defined T&C’s.
✔ You need to agree & acknowledge that, in case of anyissue pertaining to the eligibility of a user(either ‘referee’ or ‘referred’), the ultimate sole & independent decision made by DOSMIOS shall be final and binding. D-wallet offer termination T&C’s :
✔ Company reserves the right to terminate the Dosmios(D-Wallet) Offer/ Referral Programme /or modify these terms at any point of time, without notice to users. This wouldn’t affect the benefits already availed by such user.
✔ Company reserves the right to ban/disqualify any customer from this Offer if found any violation/fraudulent activity been carried out for the purpose of availing the D-wallet offer by User/or if any of the requirement/conditions towards the Offer terms are not met or found ineligible to same.
✔ These terms are in addition to and not a swap/substitution for the T&C’s on the Dosmios App / website or other product(s)/ service(s) specific T&C’s. Further, these terms shall be governed by and construed in accordance with the laws of India without reference to conflict of laws principles.
